The rules of the realm · Effective November 1, 2026
Every realm has its laws. These are ours. They keep the game fair, keep players safe, and explain what
you can expect from us and what we expect from you.
Please read: these Terms are a legal agreement between you and Titan Application Development,
LLC, a Florida limited liability company ("we", "us"), which runs Realm of Forgotten Souls (the "Game") at
realmofforgottensouls.com and in our app. Section 15 says that disputes are settled by individual arbitration, not class
actions or jury trials, unless you opt out within 30 days. How we handle your information is in our
Privacy Policy.
13 and olderUnder 18? Play with a parent's permission.
Play fairNo bots, cheats, exploits or harassment.
Gold is for the realmVirtual items are licensed, not owned, and can't be cashed out or traded for real money.
Disputes, fairlyTalk to us first, then individual arbitration.
Section 1Agreeing to these Terms
By creating an account, or by playing the Game, you agree to these Terms. If you do not agree, please do not play.
Section 2Who may play
You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you may play only with
the permission of a parent or guardian, who should read these Terms with you, and you need their permission for any
purchase. Nothing in these Terms takes away any right the law gives minors or their parents. You may not play if we have
banned you before.
Section 3Your account
Use an email address you control, and keep your password secret. You are responsible for what happens on your account.
One person per account. Do not share, sell, trade, buy or transfer accounts or characters.
Character names must not be offensive, hateful, sexual, impersonate anyone, or contain personal information. We may
rename any character.
Section 4Rules of conduct
play fair, be decent, and don't break the game or the law.
No cheating: no bots, macros, automation, modified clients, packet tampering, or software that plays for you or
gives an unfair advantage.
No exploiting: report bugs and glitches instead of using them. We may undo anything gained through them.
No harassment: no threats, bullying, stalking, hate, discrimination, or sexual, violent or illegal content.
No scams or real-money trading: do not defraud players or trade items, gold or accounts for real money outside the Game.
No impersonation of staff, players or anyone else, and no spam, advertising, or sharing other people's personal information.
No attacks: do not overload, probe, hack or reverse engineer the Game, its servers or other players' connections,
or reach parts of the Game you are not meant to.
Follow the law while you play.
Combat between players (PvP) is part of the Game where it is enabled; losing items or progress in fair play is not a violation.
Section 5Enforcement
If we reasonably believe you broke these Terms, put players or the Game at risk, or the law requires it, we may warn you,
remove content, rename a character, undo items or progress, or suspend or permanently ban your account. We decide based on
what happened, and for serious or repeated violations we may act without warning. If you think we made a mistake, write to us
and we will take another look.
Section 6Virtual items and purchases
what you get is a license to enjoy items in the Game, not something you own outside it.
The Game has virtual items, gold, currency and other content ("Virtual Items"). When you buy or earn Virtual Items you
receive a limited, personal, revocable license to use them in the Game, not ownership. They have no real-world money
value and cannot be exchanged for cash.
Prices are shown before you pay, and payments are processed by Stripe. Purchases are final and non-refundable,
except where the law gives you a right to a refund or we choose to make an exception. If you live where the law gives a
right to cancel digital purchases, you ask us to deliver your purchase at once, and you understand that once it is
delivered the right to cancel ends where the law allows.
Donations are voluntary payments to support the Game. Titan Application Development, LLC is a for-profit
company: donations are not charitable contributions and are not tax-deductible. Any reward offered with a
donation is described when you donate.
Parents: if your child made a purchase without your permission, contact us and we will review it for a refund.
A refund returns the item. If a payment is refunded or charged back after the item was used or given away, we may
suspend the account until it is settled. If we find a chargeback was fraudulent, we may close the account.
We may change, rebalance, limit or remove Virtual Items and features, which can change how useful they are in the Game.
Section 7Your content
You keep ownership of what you write in the Game (chat, mail, feedback). You give us a worldwide, royalty-free license to
host, store, display and moderate it, and to use it to run and improve the Game. Only post what you have the right to share.
Our staff may review and remove content, including private messages, to keep players safe and enforce these Terms. We are not
responsible for what other players post.
Section 8Feedback
We love hearing ideas. If you send suggestions, we may use them freely, without payment or credit.
Section 9Our game and your license
The Game, including its software, art, music, story, characters, names and logos, belongs to Titan Application Development,
LLC or its licensors and is protected by law. We give you a limited, non-exclusive, non-transferable, revocable license to
play the Game for your personal, non-commercial entertainment. You may share screenshots and videos of your own play. You may
not copy, sell, modify, decompile or redistribute the Game or its content.
Section 10Copyright complaints (DMCA)
We respect copyright. Our designated agent for notices of claimed infringement is: Copyright Agent, Titan Application
Development, LLC, 43725 Bear Lake Blvd., DeLand, FL 32720, USA, phone (386) 624-2920,
support@realmofforgottensouls.com (subject "DMCA").
Sending a notice
Include: the work you say is infringed; the material and where it is in the Game; your name, address, phone and email; a
statement that you believe in good faith the use is not authorized by the owner, its agent or the law; a statement, under
penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your
physical or electronic signature.
Counter-notice
If your content was removed and you believe that was a mistake or misidentification, send the agent: your name, address,
phone and signature; the removed material and where it was; a statement under penalty of perjury that you believe in good faith
it was removed by mistake or misidentification; and your consent to the jurisdiction of the federal court for your address (or,
outside the US, any district where we may be found) and to accept service from the person who sent the notice. We may restore
the material in 10 to 14 business days unless that person tells us they have filed a court action.
We will close the accounts of repeat infringers in appropriate circumstances.
Section 11Ads and other services
Our Android app shows ads served by Google AdMob, and payments are handled by Stripe. Other companies' services are governed
by their own terms, and we are not responsible for them or for websites we link to.
Section 12A growing realm
Realm of Forgotten Souls keeps growing: we add, balance and improve things all the time, and now and then we may change or
retire a feature. We work hard to keep the realm online and your progress safe, but like any online game it can occasionally
be down for maintenance or run into a problem. If we ever had to close the Game for good, we would tell you ahead of time.
Section 13Disclaimers
The Game is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties,
express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and we do not
promise that the Game will be uninterrupted, error-free or secure, or that data or Virtual Items will never be lost.
Section 14Limits of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or
punitive damages, or for lost profits, data, goodwill or Virtual Items. Our total liability for any claim about the Game or
these Terms is limited to the greater of (a) US $100 or (b) the amount you paid us in the 12 months before the claim.
These limits do not apply to liability for our gross negligence, willful misconduct or fraud, or to any liability that the
law does not allow to be limited. If you are a New Jersey resident, the exclusion of punitive damages and the disclaimer of
implied warranties in sections 13 and 14 do not apply to you. Anywhere else a part
of this section or section 13 is not allowed, that part does not apply to you and the rest still does.
If you are an adult, you agree to cover our reasonable losses and costs (including attorneys' fees) from claims by others
caused by your breaking these Terms or the law, or by content you post.
Section 15Disputes and arbitration
if something goes wrong, we talk first. If that fails, a neutral arbitrator decides your individual case,
usually by video, and you can opt out of this within 30 days.
15.1 Talk first
Before either of us starts a formal claim, the one with the complaint must describe it in writing (you: by email to
support@realmofforgottensouls.com; us: to your account email), and we
both try in good faith to settle it for 30 days. Deadlines for bringing the claim pause during those 30 days.
15.2 Binding individual arbitration
Except as set out in 15.3 and 15.4, any dispute between you and us arising from or relating to these Terms or the Game will be resolved
by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration
Rules. The arbitrator decides all questions about whether a dispute must be arbitrated, except questions about 15.3, which a
court decides. The hearing will be by video or phone, or in person in the county where you live, as you choose. We will pay
the AAA filing and arbitrator fees beyond what the Consumer Rules require you to pay, unless the arbitrator finds your claim
frivolous. The Federal Arbitration Act governs this section 15.
15.3 No class actions or jury trials
Except as 15.4 and 15.5 provide, you and we may bring claims only individually, not as a plaintiff or class member in any
class, collective or representative proceeding, and the arbitrator may not consolidate claims of different people into one
proceeding. If the class waiver in this paragraph is found unenforceable for a claim, that claim (and only it) will be heard in
court, not arbitration, after any individual arbitration ends.
To the extent the law allows, where a dispute is heard in court, you and we waive any right to a jury trial.
15.4 Exceptions
Either of us may bring an individual claim in small-claims court, and either of us may ask a court to stop infringement of
intellectual property or cheating, hacking or attacks on the Game. Nothing here waives your right to seek public injunctive
relief where the law protects that right; such a request will be decided by a court after any individual claims that must be arbitrated are resolved.
15.5 Many similar claims
If 25 or more similar claims are filed against us by the same or coordinated lawyers, they will be handled under the AAA
Mass Arbitration Supplementary Rules, in batches, so that every claim is heard and resolved fairly and efficiently.
15.6 Opting out
You may opt out of arbitration by emailing support@realmofforgottensouls.com
(subject "Arbitration opt-out") with your name, your account email and a statement that you opt out, within 30 days after you
first accept these Terms (for accounts created before these Terms were first shown to you: within 30 days after we first show
them to you in the Game). If you opt out, sections 15.2, 15.3 and 15.5 do not apply to you; the rest of these Terms, including
15.1, 15.4 and 15.7, still does.
15.7 Law and courts
These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law
rules. Where a case is heard in court, it will be in the state or federal courts serving Lake County, Florida, unless the law
lets you bring it where you live.
Section 16Ending your account
You may stop playing at any time and ask us to delete your account: in the Game, choose Feedback → Delete My
Account, or email support@realmofforgottensouls.com. We delete
it within 30 days. We may suspend or close accounts as
described in section 5. Sections 6 to 10 and 13 to 18 continue to apply after your account ends.
Section 17Changes to these Terms
We may update these Terms. We will change the "Effective" date, and we will give notice of significant changes in the Game or on
our website at least 30 days before they take effect. If you do not agree, stop playing and ask us to close your account before
then; continuing to play after that date means you accept the change. A change to section 15 will not apply to a dispute we
already knew about, or that was already filed, before the change took effect, and will not undo an opt-out you already made
under 15.6.
Section 18General
Whole agreement: these Terms are the whole agreement between you and us about the Game. The
Privacy Policy explains how we handle information; it is not part of this contract.
If part fails: except as section 15.3 says, if any part of these Terms is unenforceable, the rest stays in effect.
No waiver: if we don't enforce a term right away, we can still enforce it later.
Transfer: you may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale.
